Joe, the lawyer is going to do whatever you want -- as long as you're willing to pay him. It would be cheaper for you just to buy the springs and install them. BUT -- if I were you I'd call Indy and explain the problem (and mention the seller) to them. They may not pay to replace the springs, but they might agree to swap them out if you send the others back. They might tell the supplier to do the same, or stop selling him heads if he's not going to take care of his customers. Just be polite and don't lose your cool with them. You really need to disassemble and thoroughly clean those heads before you use them anyway. There is usually some machining grit left in them from the factory.
